1. About Kiraee
Kiraee is a neutral marketplace platform that enables landlords to list rental properties and tenants to browse, make offers, and securely book. We facilitate payments via a third-party provider and include an escrow process for releasing funds after key handover confirmation.
2. Acceptance of Terms
By accessing or using Kiraee, you confirm that you:
- Have read and accepted these Terms & Conditions
- Agree to comply with all rules and policies herein
If you do not agree, please do not use the platform.
3. User Responsibilities
Tenants must:
- Provide accurate identity and payment information
- Submit genuine offers
- Make payment within 24 hours of offer acceptance
- Confirm or dispute key handover within 48 hours after landlord confirmation
Landlords must:
- List only properties they legally own or manage
- Provide accurate descriptions and photos
- Respond to offers promptly
- Confirm key handover truthfully
4. Payment and Escrow Process
- Payments are processed by a third-party provider (e.g., Stripe).
- Funds are held in escrow until key handover confirmation.
- If the landlord confirms first, the tenant has 48 hours to confirm or dispute.
- If the tenant confirms first, payment is released immediately.
- If the tenant does not respond in 48 hours, funds are released to the landlord minus Kiraee’s service fee.
5. Cancellation and Refunds
Kiraee facilitates bookings but does not manage tenancy agreements.
Cancellation Policy:
- Landlords can activate a cancellation option when posting listings.
- If activated, landlords must specify a cancellation deadline (e.g., “Free cancellation until X days before move-in”).
- Tenants may cancel before this deadline and receive a full refund, excluding service fees.
- After the cancellation deadline, no refunds are available unless a verified dispute arises.
Refund Eligibility:
Refunds may be granted in these cases:
- Tenant’s valid and supported dispute (e.g., no key handover)
- Platform technical errors affecting bookings/payments
- Landlord cancels booking before move-in
Service fees are generally non-refundable except for verified platform errors.
6. Dispute Resolution and Proof Submission
If a dispute arises after key handover confirmation:
- The reporting party must provide evidence (photos, messages, etc.) within 48 hours.
- The other party has 48 hours to respond with counter-evidence.
- Kiraee reviews submissions and decides based on evidence.
- Failure to provide or respond with proof may result in a decision favoring the other party.
- Kiraee’s decisions are final and binding within the platform’s scope.
7. Service Fees
A non-refundable service fee is deducted from every successful booking, clearly displayed at checkout.
8. Account Suspension and Termination
Kiraee reserves the right to suspend or terminate accounts that:
- Violate Terms & Conditions
- Post fraudulent or misleading listings
- Attempt to bypass platform processes
9. Legal Claims and Burden of Proof
In any legal dispute or claim:
- The party making the claim must provide sufficient evidence.
- Kiraee may request supporting documents.
- Kiraee is not responsible for legal enforcement outside the platform.
- Users agree that all claims require substantiation.
10. Platform Role Disclaimer
Kiraee is solely a marketplace platform. We do not:
- Own, manage, inspect, or maintain listed properties
- Act as landlord, property manager, or legal representative
- Guarantee accuracy or safety of listings or transactions
All rental agreements and property conditions are the responsibility of tenants and landlords.
11. Intellectual Property
All platform content, branding, and design (except user listings) are owned by Kiraee and cannot be reused without permission.
12. Changes to Terms
We may update these Terms & Conditions periodically. Continued use after changes means acceptance.
